Mary Moriarty's mess

Anytime Hennepin County Attorney Mary Moriarty gets involved in a case, a mess is almost automatically guaranteed. After Renee Good's tragic shooting death, Moriarty insisted that the feds had to share the feds' evidence with the HCAO. That's false. Since it involved a federal border patrol agent, the feds have jurisdiction. Since Moriarty is an activist prosecutor, the Trump administration didn't see the usefulness in playing nice with Moriarty.

In this interview, Jake Tapper inquired what standard procedure was. He cited the Annunciation Church shooting last August and the Hortman family assassinations as instances where state and federal authorities worked together. The thing there is that both instances involved local crimes. The municipalities asked for the feds' help in the investigation. The shooting of Renee Good involved a federal agent, thereby assigning the feds jurisdiction in that investigation. This week, the "Hennepin County Attorney’s Office" announced "two-way evidence sharing between state and federal agencies for Metro Surge shootings." That's likely because the DOJ has determined that the Border Patrol agent shot Good in self-defense.

I predict that Moriarty's office will prosecute the Border Patrol agent. She might even get a conviction. That is, until a federal appeals court rules that she doesn't have jurisdiction. But, what the hey, Democrats don't care about the Constitution and things like Separation of Powers. They're scalp-hunting for a federal agent. The particulars don't matter. This is a revenge trial:

Friday night on Almanac, Moriarty didn't mention that they'd keep an open mind on whether to prosecute until late in the interview. It's as if prosecuting was a foregone conclusison. Lady Justice wears a blindfold for a reason. Presumed innocent isn't just a nice-sounding phrase. It's a constitutional requirement.

It's good that Moriarty isn't running for re-election. Prosecutors necessarily must be cold-blooded. Jack Webb's "Just the facts, Ma'am" fits a prosecutor's mindset perfectly. Defense attorney don't have to prove their case because their client is presumed innocent. It's the prosecutor who has to prove their case "beyond a reasonable doubt."
