Joe Biden's judicial legacy: from Ketanji Brown-Jackson to Kate Menendez

The only thing that Antonin Scalia and Ketanji Brown-Jackson have in common is that they were both Supreme Court justices. After that, the similarities abruptly end. Joe Biden's judicial legacy isn't just Ketanji Brown-Jackson, though. Unfortunately, it extends to Kate Menendez, the district court judge who "barred federal agents in Minneapolis from arresting peaceful protesters or using nonlethal munitions and crowd control tools against them." That's like a judge ruling that, if you're planning on breathing, you're required to breathe air.

Saying that ICE agents can't arrest peaceful protesters is nothing more than telling ICE agents that they must obey the First Amendment. That's a no-brainer. In a statement, DHS spokesperson Tricia McLaughlin said "The First Amendment protects speech and peaceful assembly, not rioting. DHS is taking appropriate and constitutional measures to uphold the rule of law and protect our officers and the public from dangerous rioters. We remind the public that rioting is dangerous; obstructing law enforcement is a federal crime and assaulting law enforcement is a felony."

That's likely the easiest statement that Ms. McLaughlin has ever had to put together.

This is what a series of DEI hires looks like. It's often rumored that Ketanji Brown-Jackson's fellow justices don't respect or like her. Who can forget this moment during her confirmmation hearing?

This past week, SCOTUS heard oral arguments om whether men should be allowed to participate in women's sports. One of the plaintiffs' attorneys was asked for the definition of a woman by Justice Alito. The attorney said that wasn't possible. Alito replied that he couldn't determine whether a person had been discriminated against if there wasn't a definition for what a woman is. Like I said, this is what happens with woke hires.

As for Ms. Menendez, that's a word salad answer that'd make Kamala Harris blush. Anyone with a brain knows that it's illegal to "arrest peaceful protesters." Finally, thank God Biden is finished making judicial nominations.
