Title IX v. MHRA (Minnesota Human Rights Act)

Apparently, the DFL operatives posing as Minnesota Supreme Court justices don't respect the constitutional principle known as the Supremacy Clause. The text of the Supremacy Clause says "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding."

Yesterday, KSTP reported "The Minnesota Supreme Court has ruled that an adult transgender athlete was discriminated against when she was banned from participating in a women’s powerlifting competition but opened the door to additional legal challenges. Minnesota’s high court issued its opinion Wednesday morning. In doing so, the court affirmed that the state’s Human Rights Act (MHRA) protects transgender people from discrimination based on sexual orientation. However, it didn’t go as far as many transgender individuals and their supporters would’ve liked."

The text of Section 1681 of Title IX of the 1972 Education Act says:

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance, except that:

(1) Classes of educational institutions subject to prohibition

in regard to admissions to educational institutions, this section shall apply only to institutions of vocational education, professional education, and graduate higher education, and to public institutions of undergraduate higher education;

Transgender men or women aren't a sex. Activists say that transgender women "identify as women." I suspect that the male powerlifter has the uphill fight because he has to sell the Eighth District judges, then SCOTUS justices, that an XY chromosome pattern is the same as an XX chromosome pattern.
