Daniel Penny's verdict

It's a semi-great day for good Samaritans in New York City. Daniel Penny has been found not guilty of criminally negligent homicide. CBS New York City is reporting that "Daniel Penny has been found not guilty of criminally negligent homicide in the chokehold death of Jordan Neely on a New York City subway car in 2023. Penny, a 26-year-old Marine veteran, pleaded not guilty to charges of second-degree manslaughter and criminally negligent homicide."

I said semi-great day because these charges shouldn't have been brought in the first place. Penny acted in self-defense.

CBS is also reporting "The judge dismissed the manslaughter charge Friday after jurors said they could not come to a unanimous decision. The jury could only consider the negligent homicide charge if Penny was cleared of manslaughter. About 15 protesters lined up outside the courthouse Monday, chanting "justice for Jordan Neely." Inside, Penny's defense team asked for a mistrial and once again was denied." Jordan Neely attacked riders on the subway car. Testimony was gioven that he said that he didn't care if he went to Riker's Island. Penny reacted before he could hurt other passengers. Some of the people in the subway carr testified that they viewed Penny as a hero.

This is just the latest dark stain on Manhattan DA Alvin Bragg's record. He should be terminated the next time he's up for re-election. Apparently, pro-Jordan Neely protesters outnumber those that think Daniel Penny did the right thing:

Because the judge dismissed the manslaughter charge earlier, this means that Penny can't be tried again. Double jeopardy has attached on both charges. Neely's family has filed a lawsuit against Penny. That will be a seperate trial, though.
