Stearns County's sanctuary county spin

Stearns County Sheriff Steve Soyka complained that Stearns County is on the Department of Homeland Security's list of sanctuary jurisdictions at a recent meeting of the Stearns County commissioners. This week, Sheriff Soyka briefed the commissioners that "We’ve been doing the same thing for 20 years with no issues, no complaints, no list generated or being put on any kind of a crazy title like this." I don't doubt that they've been "doing the same thing for 20 years with" no complaints. That doesn't mean that they've been doing things right.

It's entirely possible to do the same thing for 20 years and to do that thing wrong. According to Sheriff Soyka's report, "everyone who gets booked into Stearns County jail, regardless of race, ethnicity or religion, is treated the same. This means there is only so long law enforcement can hold a person and the county cannot hold an inmate longer just so ICE can come to pick them up."

Actually, the governing laws on holding illegal aliens is Article I, Section 8, Clause 4 of the Constitution, which gives Congress plenary authority over immigration; Article VI of the Constitution, which, through the Supremacy Clause, provides that federal law takes precedent over conflicting state laws; and Article II of the Constitution, which, through the Take Care Clause, vests within the Presidency the authority—and indeed, "the duty—to ensure the laws are faithfully executed." Anything that doesn't comply with the Constitution is unconstitutional and can't be enforced.

As for Stearns County, Sheriff Soyka needs tocomply with the U.S. Constitution. Personally, I think he knows that he isn't complying with federal immigration laws. I also think he doesn't agree with U.S. immigration law. Unless he's deputized by ICE, he can't arrest illegal aliens. That's just a dodge. What he must do, though, is turn over prisoners held in his jail if DHS issues a detainer. That's the federal law. Failing to do so is not complying with U.S. immigration law. Period.
