Peter Navarro vs Merrick Garland's DOJ

The January 6 Kangaroo Court is in for a legal fight. I won't call them a committee because they aren't obeying the rules establishing their committee. Under the rules establishing the committee, subpoenas can't be issued without a ranking member of the committee.

When Kevin McCarthy submitted his list of committee members, he named Jim Jordan as the ranking member. In an unprecedented stunt, Speaker Pelosi rejected both Jim Jordan and Jim Banks. As a result, the other named members refused to serve. Instead of stopping this charade, Pelosi named Liz Cheney and Adam Kinzinger as window-dressing for the kangaroo court.

Congressional committees have the authority to conduct oversight for legislative purposes. That's a routine part of their responsibilities. Only special authorization, specifically impeachment investigations, gives the Congress the authority to conduct oversight for law enforcement purposes. The so-called 1/6 Committee isn't authorized for that type of oversight.

Clearly, that's what this bunch of haters see as their mission. Democrats don't see it as their mission to ask questions of Nancy Pelosi about why she turned down the 20,000 National Guard troops that President Trump authorized.

This information won't be covered by the partisans. That's because their report's conclusions is largely already written. Think of their job as that of a jury whose verdict is reached before the first witness testifies or the first piece of evidence is submitted. The 'jury's' responsibility is to listen to the hand-picked witnesses, then craft their testimony into a narrative that fits the pre-determined verdict.

After all, this is Nancy Pelosi's kangaroo court. The last thing she wants is to have it known that the U.S. Capitol Police, which are 100% under her command, weren't properly trained for their mission, weren't given proper guidance from leadership and weren't properly prepared for their mission.

By itself, that's quite the condemnation of Ms. Pelosi's leadership. Further, why did she turn down the troops President Trump authorized for that day?

According to Peter Navarro's quotes from this article, Navarro "filed a civil suit against the kangaroo committee on the Hill (seven partisan Democrats and two RINO Republicans). The essence of that civil suit was that the subpoenas issued by the committee are ultra vires [beyond their jurisdiction], unlawful, and unenforceable." Then there's this:

I made that case based on four legal arguments. First is that this committee is neither duly authorized nor properly constituted, meaning that it doesn't follow the rules of either the House itself or the committee's own authorizing resolution.

...I sent them a letter on Wednesday offering a modus vivendi [agreement]. I told them contact an individual who would discuss this matter. What did they do? They didn't call me. I spoke to the FBI agent who arrested me, I spoke to him on Wednesday night, and I told him, "whatever you need. You don't have to come banging on my door like you did last week, getting me out of bed. I'm here to cooperate."

This is worth noting:
SEC. 2. COMPOSITION.

(a) Appointment Of Members.—The Speaker shall appoint 13 Members to the Select Committee, 5 of whom shall be appointed after consultation with the minority leader.

(b) Designation Of Chair.—The Speaker shall designate one Member to serve as chair of the Select Committee.

Shall is a strong statement. It's as strong as must. In practical terms, it's like saying that there isn't any wiggle room for the politicians.
